On 20 February, 2025 Lawyerly reported Allergan may bring ‘state of the art’ defence in breast implants class action
William Roberts Lawyers is representing the class action in the case of Grace Mary Ruth Donnelly v Allergan Australia Pty Limited. They filed the action in the Federal Court on behalf of lead applicant Grace Donnelly, who underwent breast augmentation surgery in 2017 using Allergan 410 MF textured breast implants. The class action claims that Allergan did not comply with the Australian Consumer Law’s guarantee of acceptable quality and seeks compensation for loss and damage caused by the breach, group members’ costs, and damages for mental distress.
The implants were recalled in July 2019 by the Australian Therapeutic Goods Administration and Allergan after the US Food and Drug Administration reported higher occurrences of breast implant-associated anaplastic large cell lymphoma (BIA ALCL) in patients who received the textured implants. The class action alleges that recipients of the textured implants were significantly more likely to develop BIA ALCL due to a chronic inflammatory response caused by the implants
