Walton Construction Class Action

The Claim

William Roberts Lawyers are acting for the Applicant in Federal Court proceedings VID993/2019, Williams & Kersten Pty Ltd v National Australia Bank Ltd.

These proceedings arise from the collapse of the Walton Construction group of companies, which entered insolvency in 2013.  The Respondent was the principal lender to the Walton group, and the claimant class is comprised of group creditors such as subcontractors whose invoices went unpaid.  The proceedings allege that the Respondent engaged in misleading and deceptive conduct, unconscionable conduct and equitable fraud in relation to its dealings with the Walton group which increased creditor losses.

IMPORTANT NOTICE TO GROUP MEMBERS REGARDING PROPOSED SETTLEMENT

On 5 February 2025, the Federal Court of Australia ordered that an important notice be issued to group members in the Walton Construction Class Action. This is a Notice of Proposed Settlement (Notice).

This Notice provides group members with information concerning their rights in the class action:  Notice of proposed settlement – approved by the court on 5 February 2025
