INSURANCE

PROFESSIONAL RISK

Specific areas covered under our Professional Risk capabilities are: Professional Risk and Directors & Officers

Professional Risk

William Roberts Lawyers is regularly retained on behalf of professional indemnity insurers to act for a wide range of professionals, including:

  • Financial advisers and accountants;
  • Building and construction professionals;
  • Health and allied health practitioners;
  • Real estate agents;
  • IT professionals;
  • Solicitors.

Our approach is to consult with the professional at an early stage, to ensure familiarisation with the issues in dispute and to assist in the formulation of an appropriate case strategy.  That strategy might variously include instructing expert witnesses, the joinder of other parties or the making of an early protective offer. In all instances, our philosophy is to adopt a common sense approach to claims, focused on commercial outcomes rather than on process.

We ensure that underwriters, claims personnel and insureds are kept fully informed of all significant developments in the lifecycle of the claim. Indemnity issues are dealt with sensitively and at an early stage.

Directors & Officers

Our teams has acted for directors, officers and their insurers across a variety of industries.  In addition to conducting the defence of claims, we have acted as coverage and monitoring counsel.  We are able to assist underwriters with policy wording and endorsements.

Claims where we have acted:

  • ASIC investigations;
  • Occupational health and safety investigations and prosecutions;
  • Equal opportunity claims;
  • Defamation proceedings;
  • For the Directors and Officers at a Managed Investment Scheme;
  • Directors and Officers at a company.
