Simon Chen

My main practice is in commercial litigation, dispute resolution and general disputes. I have worked in matters across different states and territories, the Federal jurisdiction, in matters at first instance and in the appellate jurisdictions, including the High Court of Australia, and in matters extending over international borders.

I have over a decade’s experience in the legal profession and have been with William Roberts since 2015.

I have represented insurers, insureds, owners corporations, community associations, individuals, developers, companies and associations, directors and officers, trustees, medical professionals, members of parliament, business people and legal professionals, amongst others. I have worked with litigation funders.

I have been involved in many matters involving complex, highly technical and intricate questions of law, including conflict of laws, however, my focus is on delivering successful settlements and obtaining judgments in favour of my clients in a practical and commercial manner, in line with client interests.

Who I work with and what I do

My practice spans across many areas, some of which include:

  • Insurance matters, including home and contents, product defect and subrogated motor vehicle accident claims, under section 54 of the Insurance Contracts Act 1984 (Cth), and claims made on motor vehicle and home insurance policies dealing with non-disclosure, misrepresentation, fraud and other policy breaches;

  • Consumer protection and competition law claims, including statutory guarantees, misleading and deceptive conduct, unconscionable conduct and breaches of the Franchising Code of Conduct;

  • Corporations and associations law matters, including involving allegations of breaches of directors’ duties and claims of oppression;

  • Property, leasing, strata and community title, planning, construction, retaining wall and fencing disputes;

  • Debt recovery, by financial institutions and private clients, and insolvency matters;

  • Cyber, data breaches and privacy law;

  • Administrative and constitutional law; and

  • Class actions, including mass torts and shareholder actions.

Where I studied

I have a double degree in Finance (with merit) and Law from the University of New South Wales.

What I like to do

Outside of work, when time permits, I have an interest in collecting and tasting different teas, playing chess and reading.
