Zayd Chothia

I am the QLD Insurance Team Co-Leader and have experience in commercial litigation, insurance, debt recovery and insolvency matters.

I act for government and institutional clients, and insolvency practitioners in both the corporate and private sectors.

Who I work with and what I do

  • I have acted as principal panel lawyer for the Queensland State Government on its panel undertaking recovery and enforcement matters pursuant to statutory powers, and recovery of statutory debts;
  • I act for a publicly listed automotive company and international commercial collection agency nationally in commercial litigation disputes, and commercial debt recovery matters;
  • I act for leading national and international insurers, and insureds;
  • I have advised company directors in claims brought by liquidators of a junior start-up mining exploration company in relation to public examinations and subsequently, in separate Supreme Court of Queensland proceedings brought by the liquidators for insolvent trading;
  • I act for Australia’s leading freight carrier in defending unfair preferential claims pursued by liquidators of insolvent trading companies;
  • I acted for a proprietary limited company (subject to Deed of Company Arrangement), and its Administrators in separate complex Supreme Court (Queensland) and Federal Court of Australia proceedings, where the Supreme Court proceedings concerned alleged retention of title and conversion of stock, and the Federal Court proceeding concerned a challenge to the validity of the Deed, which disputes were settled after a mediation before Sir Laurence Street;
  • I acted for a mobile village owner seeking a Supreme Court judicial review of a judgment awarded against it. The Supreme Court found there had been a denial of natural justice and ordered the judgment to be set aside together with costs.
  • I have advised a major international agrichemical company in its opposition of Supreme Court winding up proceedings, where there were allegations of breach of trust and oppression, and associated proceedings to obtain Mareva orders and subsequently to appoint a provisional liquidator to a subsidiary company.
  • I am acting for property owners regarding contractual rights in Supreme Courts, and the Queensland Court of Appeal.

What I like to do

Experience a wide variety of cuisine, spend time outdoors exercising particularly bushwalking or swimming and going to the beach, and enjoy watching all different sports.
