In an important decision on 27th September, 2023, Justice Delany of the Supreme Court of Victoria has awarded William Roberts Lawyers and Maurice Blackburn carriage of the Downer class action see Downer Class Action Judgement
This was a hard fought victory by our team in a matter that originally involved four competing proceedings across both the Supreme Court of Victoria and the Federal Court of Australia.
The principal basis for Justice Delany’s decision was “the proven track record of the practitioners and the lead plaintiffs in the Lidgett consolidated proceeding of cooperating and resolving their differences”, which gave his Honour confidence that we would act in the best interests of group members, and would discharge our overarching obligations pursuant to the CPA, likely resulting in savings of time and costs and, as a result, increasing the prospect of a more favourable return to group members (see [146]).
