Sebastian Brodowski

Sebastian is an Accredited Specialist (Commercial Litigation) and an experienced litigator has experience in most aspects of insurance litigation.

Sebastian’s experience in litigation to include all aspects of insurance law, acting on behalf of insurers in both plaintiff and defended matters as well as advising insurers on policy coverage.  

Since his admission, Sebastian has advised and litigated a number of matters on behalf of insurers including insurance fraud, indemnity disputes and product liability matters that have encompassed the application of the common law along with the Insurance Contracts Act 1984 (Cth), Trade Practices Act 1974 (Cth) and now the Australian Consumer Law (ACL).

In addition, Sebastian has continued to act on behalf of insurers in subrogated disputes in common law negligence claims, public liability claims and professional indemnity claims.

Sebastian regularly advises clients on the legal, commercial and practical aspects of each dispute with a view to ensuring that the client receives a commercial resolution to each dispute.He is also a member of the Law Society of New South Wales Litigation Law and Practice Committee and a former member of the Professional Conduct Committee and Legal Technology Committee.Sebastian’s recent experience includes being instructed:

  • by various insurers in general insurance disputes including motor vehicle collisions, home and contents claims, fraudulent claims, indemnity disputes and product liability disputes
  • by insurers in public liability disputes involving claims arising in shopping centres and domestic residences
  • by insurers in professional negligence claims against various professionals and business entities as well as advising insurers on policy coverage
  • by financial institutions in debt recovery and bankruptcy matters.
