Kezia David

Kezia has appeared in Local, District and the Supreme Court of NSW and their counter-parts in Victoria, Queensland and ACT, the Federal Court of Australia, NCAT, FOS (instructed for insurers and financial Institutions), Fair Work Australia, Medical Council, HCCC, Dental Board and Victims Compensation Tribunal.

Kezia is generally instructed by individuals, government and private institutions, directly or indirectly (by the subrogated insurers or private funders), in advisory and litigated matters including:
  
  
  • Actions involving property damage
  • Professional indemnity claims involving matters litigated in Courts and complaints to the HCCC and Medical Council;
  • Defended actions for claims arising in personal injury;
  • Enforcement of judgments and cost assessments;
  • Commercial disputes, including contracts for services or commercial supply and joint venture disputes;
  • Employment disputes, including applications with Fair Work Australia;
  • Preparation and the administration of Wills, Guardianships and Powers of Attorneys;
  • Provision under a Will pursuant to the Succession Act involving an array of issues including rectification of the Will and removal of executor; and
  • Compensation claims by victims of crime.

Of note,  Kezia has:

  • Been instructed in public interest cases involving unsettled areas of law. She successfully resolved a case against a well known law firm for the benefit of participants and their private funder in a prominent representative action. The case posed questions regarding the business interest considerations of solicitors and their obligations to their clients in the context of commercial conflicts of interest.
  • Successfully submitted a proposal regarding the erroneous treatment of complaints involving allegations of fraud in the context of insurance contracts now accepted by FOS for the benefit of insurer respondents.
